NEXTGEN FAXING SOLUTION ADDENDUM

Effective as of January 1, 2024 (Version Number: 45292)

All terms not defined herein shall have the meaning ascribed to them in the DAS Standard Incorporated Terms and Conditions.

NextGen Faxing Solution.   If the executed COF includes NextGen Faxing Solution, the following additional terms apply:  Client has requested that DAS utilize Client’s existing legacy, on-premises faxing solution (“Legacy Faxing”) to be accessed by Client’s hosted Software and hosted servers. Client acknowledges its Legacy Faxing was no longer supported by NextGen Healthcare as of October 1, 2021. Therefore, Client agrees to hold DAS harmless for any and all damages, including but not limited to any service level degradation related to Client’s Legacy Faxing. Client agrees that additional fees may be incurred should Client require DAS to remediate any issues with its Legacy Faxing. Further, Client acknowledges that should its Legacy Faxing be deemed unusable or unsupportable by DAS, in DAS's sole discretion, DAS will provide a transition to the NextGen supported eFax® Corporate solution for additional monthly fees which will be added to Client’s monthly Hosting Services Fees as Additional Charges for the duration of the Hosting Services Term.
