REMOTE PATIENT MONITORING ADDENDUM

All terms not defined herein shall have the meaning ascribed to them in the DAS Standard Incorporated Terms and Conditions.
Remote Patient Monitoring (“RPM”) – If the executed COF includes Remote Patient Monitoring (“RPM”) in any form, the following additional terms and conditions apply:
- Primary Service. DAS will use reasonable commercial efforts to generate all enrollment documentation and perform some or all of the RPM services as follows (for each respective service included in the COF):
- Provide device and device set up assistance per CMS’s guidelines under CPT Code 99453, billable only one time per patient device enrolled. Devices will be shipped directly to the patient by DAS. With respect to any device defects, DAS is responsible for replacement with new devices, which is Client’s sole remedy;
- Provide follow up to patient for data monitoring per CMS’s guidelines under CPT Code 99454 for each patient who enrolls in the program, to include 16 days of patient data submitted within a 30-day period; and/or
- Provide at least 20+ minutes of non- face-to-face time monthly, including one verbal encounter, a comprehensive assessment of and care planning for patients requiring remote patient monitoring services per CMS’s guidelines under CPT Code 99457 for each patient who enrolls in the program.
- Care Plan. DAS shall also create and maintain an electronic care plan (care coordination document), for each patient, addressing the patient’s needs corresponding to the device utilized for Remote Patient Monitoring.
- Documentation Management. DAS shall maintain sufficient documentation of provided services, including time spent communicating with each patient, and with other treating health professionals, for care coordination.
- Account Services. DAS shall use reasonable commercial efforts to assign an experienced, industry- credentialed account representative to serve as Client’s direct service contact. The account representative will be supported by an operations and technical-service team available 24/7/365. DAS will use reasonable commercial efforts to provide Client monthly with a complete list of enrolled patients who may be eligible to be billed pursuant to RPM Services listed above.
- Client’s Responsibilities.
- Client shall give DAS full and complete access to its EHR system within seven (7) days of the Effective Date, and continuously thereafter on a real-time (or near real-time) basis, including the ability to update the care plan for each patient in the RPM Services;
- Client shall identify all of Client’s Medicare/commercial patients who qualify for RPM services under CPT Code 99453 (i.e., having at least 1 chronic condition). Client’s physician practitioner is solely responsible for determining which patients are eligible for service, ordering of the services and billing.
- With DAS’ assistance, Client shall inform all qualifying and interested patients of the nature of the RPM services to be provided by DAS, the patient’s responsibility for any associated co-pays and/or deductibles, the possible need for sharing their health information with other practitioners, and the patient’s right to disenroll from the program at any time.
- Client shall enroll its first patient under this Addendum within forty-five (45) days of the Effective Date, and shall use reasonable commercial efforts to enroll at least 10% of all eligible patients within the first six (6) months from the Effective Date.
- Client is solely responsible and liable for ensuring a face-to-face visit is conducted with any patient receiving RPM Services, provided such face-to-face visit is required by CMS. Patient must be an active patient within the practice having been seen within the last 12 months prior to beginning services.
- Client is solely responsible and liable for determining and ensuring whether or not the necessary 30-day time element or component of the RPM Services has been met.
- Client is solely responsible for the appropriate billing and collections from CMS, and if applicable, from its enrolled patients, any and all amounts owed relating to the RPM Services provided, whether provided by the Client or DAS.
- Client is solely responsible and liable for full compliance with all CMS rules, regulations, requirements and procedures, as may be amended from time to time, relating to the RPM Services.
- Client (not DAS) is the “directing” party with regard to CMS’s guidelines specifying the need for RPM services to be directed by a physician or other qualified health care provider.
- Any dispute related to a patient denial by a payer for RPM Services, must be reported within 30 days following the receipt of billing details by DAS. Such requests must be accompanied by an Explanation of Benefits (EOB) document outlining the reason for the denial. Failure to report any disputes or provide the necessary documentation within this time frame will result in the waiver of any rights to raise such disputes in the future.
